Let\u2019s face it<\/strong>, we all love using quotes in our writing.<\/p>\n

Not only does it save us the trouble of coming up with our own words, but it\u2019s also fun to insert some famous lines, and sometimes there\u2019s just no way to improve on greatness.<\/p>\n

However, those pesky copyright laws make quoting problematic, and we don\u2019t want to get in trouble for using someone else\u2019s words.<\/p>\n

So, when is it okay to use quotes in your book?<\/strong><\/p>\n

When You get Permission<\/h2>\n

Permission is the gold standard.<\/p>\n

If you get permission<\/strong> from the copyright owner, you have a green light to proceed.<\/p>\n

However, be aware that getting permission can be tricky — not all copyright owners are easy to track down, and it\u2019s not uncommon to get no response from your request.<\/p>\n

They may also reject your request, or demand a fee that\u2019s higher than you\u2019re willing or able to pay.<\/p>\n

When the Quote is Not Copyrighted<\/h2>\n

You can\u2019t have copyright infringement when there\u2019s no copyright.<\/p>\n

So if the work you\u2019re quoting<\/strong> from is not copyrighted, there\u2019s no issue.<\/p>\n

In the U.S., anything published before 1930 is in the public domain, meaning the copyright has expired and it\u2019s free for anyone to use.<\/p>\n

So go ahead and quote Shakespeare in front of every chapter, you won\u2019t get in trouble.<\/p>\n

When the Quote is De Minimis<\/h2>\n

If the quote is a tiny fraction of a bigger work, the courts may declare it \u201cde minimis,\u201d meaning it\u2019s such a small piece the use can\u2019t harm the copyright owner, and therefore it\u2019s not infringing.<\/p>\n

But be aware that your definition of small may not align with the copyright owner\u2019s definition, so it\u2019s a shaky foundation to rest your case on.<\/p>\n

When It\u2019s Fair Use<\/h2>\n

Fair use is an exception to copyright infringement rules.<\/p>\n

The idea is that<\/strong> your use serves a public benefit that outweighs the harm to the copyright owner, so there\u2019s no infringement.<\/p>\n

But fair use is probably the trickiest of all these options, because there are no hard rules for when something is or is not fair use.<\/p>\n

There is a test that can serve as a guideline<\/strong>, but the court\u2019s decision is often subjective.<\/p>\n

So fair use should be a last resort rather than a first option.<\/p>\n

As much as we all love quotes, using them is much like walking through a minefield.<\/p>\n

You\u2019ll need to decide<\/strong> if you want the quote badly enough to make the trek.<\/p>\n
