Grant of Rights. <\/b><\/h2>\n<p>This is, in many ways, the heart of the contract. It lays out what rights you are giving the publisher over your work.<\/p>\n<p><strong>Generally, the bigger the publisher<\/strong>, the more rights they will ask for.<\/p>\n<p>So you could grant the publisher as little as the right to print your book in English in North America for the next five years or as much as all your copyright rights worldwide for the entire duration of your copyright.<\/p>\n<p><strong>Read this clause<\/strong> carefully to know how much you\u2019re giving, and make sure you\u2019re comfortable with it.<\/p>\n<h2><b>2. Royalties.<\/b><\/h2>\n<p>This one is fairly obvious, but I would be remiss if I didn\u2019t include it. Check to see how much they\u2019re paying you and how frequently they pay.<\/p>\n<p><strong>A few notes:<\/strong><\/p>\n<ul>\n<li aria-level=\"2\">Check to see if they\u2019re giving percentages based on \u201csuggested retail price\u201d or \u201cnet sales receipts.\u201d The suggested retail price would give you more money per book, but the publisher may lower the royalty rate if you ask to switch.<\/li>\n<li aria-level=\"2\">Look to see if there\u2019s an \u201caudit clause\u201d &#8212; this would give you the ability to audit the publisher to make sure they\u2019re paying you the right amount.<\/li>\n<li aria-level=\"2\">Keep in mind that a bigger advance often means a lower royalty rate.<\/li>\n<\/ul>\n<h2><b>3. Termination clause.<\/b><\/h2>\n<p>This is the clause that many authors wished they had in their contracts.<\/p>\n<p><strong>You want to make sure there\u2019s a way to end this relationship<\/strong> if you\u2019re unhappy with your publisher.<\/p>\n<p>Many contracts only have an \u201cout of print\u201d clause, stating that you get your rights back when the book goes out of print.<\/p>\n<p>But with print on demand, publishers can keep the book \u201cin print\u201d forever.<\/p>\n<p><strong>So you want to either have a way you can terminate<\/strong> the contract on your end or define \u201cout of print,\u201d so it actually has a chance of happening.<\/p>\n<h2><b>4. Dispute Resolution.<br \/>\n<\/b><\/h2>\n<p>Another important clause is the \u201cdispute resolution\u201d clause.<\/p>\n<p><strong>Basically, it lays out how things get resolved<\/strong> when you and your publisher have a fight you can\u2019t figure out on your own.<\/p>\n<p>It states where a trial would be held and if you have to try a different method before you go to court (usually you do; no one likes court except the lawyers).<\/p>\n<p><strong>The two most common alternative<\/strong>s are arbitration (a simplified trial) or mediation (the parties sit with a mediator and try to work things out like adults).<\/p>\n<h2><b>5.
