I was presented with an interesting question awhile back.<\/strong> A writer was successful enough to have a fanbase, who would sometimes send her fanfiction they wrote based on her novels.<\/p>\n

At one point, a fan sent her some fanfiction that aligned very closely with the plot of her upcoming novel. That made her concerned that, if she published the novel with the existing plotline, the fan might sue her for copyright infringement.<\/p>\n

What should she do?<\/strong><\/p>\n

What is fanfiction?<\/h2>\n

Before I dive into that question, I want to backtrack and talk about fanfiction in general.<\/p>\n

For those who are not familiar with the term<\/strong>, fanfiction is when fans write stories that take place in the author\u2019s fictional universe.<\/p>\n

For example, one of the earliest popular fanfiction stories took place in the Star Trek universe, where the fan created a new crewmember of the Starship Enterprise and wrote stories about this new character.<\/p>\n

Fanfiction can be quite entertaining, but it creates a problem for the author of the original series.<\/p>\n

On the one hand<\/strong>, these stories written by fans technically infringe on the author\u2019s copyrights, namely the right to create derivative works based on the original.<\/p>\n

On the other hand, the infringers are fans, usually devoted hard-core fans, and cracking down on them could potentially alienate the author\u2019s fan base.<\/p>\n

Most authors choose to allow fanfiction, as long as it\u2019s clear that it is fanfiction and not an official part of the canon.<\/p>\n

When the fan tries to pass it off as an official work<\/strong>, and\/or tries to monetize their fanfiction, then the author will step in and enforce their rights.<\/p>\n

When Fanfiction Is A Problem<\/h2>\n

But what about the problem I opened with, where someone\u2019s fanfiction is eerily similar to the author\u2019s work in progress?<\/p>\n

Technically<\/strong>, since the author wrote the manuscript before seeing the fanfiction, there is no infringement, since the author didn\u2019t copy anything.<\/p>\n

However, proving that in court is something else entirely.<\/p>\n

If the author can\u2019t prove that the manuscript was written before she ever saw the fanfiction, then she could very well lose the case.<\/p>\n

If she documented when she received the fanfiction<\/strong>, the status of her manuscript at the time, et cetera, then she would likely be fine, but that wouldn\u2019t avoid the visit to the courtroom.<\/p>\n

In this instance, she chose to simply re-write the manuscript to avoid the problem.<\/p>\n

Another method that could prevent this issue would be to have a policy of never reading your own fanfiction; if you never read it, you can\u2019t have copied it.<\/p>\n

This is certainly less fun, but it\u2019s probably the safest route overall.<\/strong><\/p>\n
