\"What<\/a>Let\u2019s welcome back monthly columnist Kelley Way<\/a> as she shares with us \u201cWhat is Intellectual Property?\u201d Enjoy!<\/p>\n

I throw the term \u201cintellectual property\u201d around quite a bit<\/strong>, but non-lawyers may not be quite as familiar with the term.<\/p>\n

Let me explain what intellectual property is and the four main types of intellectual property.<\/p>\n

Creations of the Mind<\/h2>\n

\u201cIntellectual property\u201d refers to creations of the mind \u2013 things that can be bought or sold and have economic value but are not physical items you can touch.<\/p>\n

(Accountants call them \u201cintangible assets,\u201d which are basically the same thing for our purposes.)<\/p>\n

While there may be more types of intellectual property that I\u2019m not thinking about, <\/strong>they mostly come in four flavors — copyrights, trademarks, patents, and trade secrets.<\/p>\n

Copyrights protect creative expression — books, movies, music, art, etc.<\/p>\n

Since the point is to protect the products of your creative genius, only the creative aspect gets protection — for example, a book\u2019s copyright will not protect the facts and ideas within the book, but it will protect the language used to express and explain those ideas.<\/p>\n

In the same way<\/strong>, a copyright for artwork created from an underlying image will only get protection for the elements that were added to the image (but if the original image has a copyright, it\u2019s still protected under its own copyright).<\/p>\n

Protecting Your Brand<\/h2>\n

Trademarks protect your brand in the marketplace.<\/p>\n

Logos, company names, product names, and slogans are all things that can be protected under trademark law.<\/p>\n

The idea here is to ensure buyers know who they\u2019re buying from<\/strong>, and sellers can build a reputation around their brand so people want to buy from them.<\/p>\n

Essentially, anything you use to identify yourself in the marketplace can potentially get trademark protection.<\/p>\n

Patents cover things of a more scientific nature — processes, formulas, inventions and the like.<\/p>\n

It still has to be original to the inventor<\/strong>, so you can\u2019t patent sliced bread, but if you come up with a machine that slices and dices in a way no one has thought of before, then you can patent it.<\/p>\n

Trade Secrets<\/h2>\n

Trade secrets are just like they sound.<\/p>\n

These are company secrets that are kept under lock and key, like the Coca-Cola recipe.<\/p>\n

Trade secrets never expire; they stay protected until the secret gets out.\u00a0<\/strong><\/p>\n

Companies can get into serious trouble if they use underhanded means to discover their competitor\u2019s trade secrets.<\/p>\n

Of course, there\u2019s much more to say about each of these intellectual property subsets, but that\u2019s a basic overview of each one.<\/p>\n
