Whenever I talk about copyright law<\/strong>, I inevitably get asked, \u201cIs it okay if I only use x % of a [song\/movie\/book]?\u201d\u00a0<\/span><\/p>\n

Sometimes I\u2019ll get the variation, \u201cHow much is too much?\u201d<\/span><\/p>\n

And even,<\/strong> \u201cCan I use this song, video, picture, etc., if I only take a little bit?\u201d\u00a0<\/span><\/p>\n

I always point out that no \u201cbright-line\u201d rule clearly states how much is okay and what will tip the scale over the line into infringement.<\/span><\/p>\n

This issue is decided on a case-by-case basis,<\/strong> so you won\u2019t know for sure if your use is okay until after the lawsuit is over.<\/span><\/p>\n

However, there are some guidelines used by the courts to decide when the use is <\/span>\u201c<\/span>de minimis<\/span><\/a>\u201d (<\/span>la<\/span>wyer-speak for \u201ctoo small to bother with\u201d), and I\u2019ll share those here.<\/span><\/p>\n

How Much Can I Use with De Minimis? The Quantity Question\u00a0<\/span><\/h2>\n

The first question the court will ask is, \u201cHow much was copied?\u201d<\/strong>\u00a0<\/span><\/p>\n

If a poem is 10 pages long and you use 10 words, the court will probably decide that the amount copied was negligible.<\/span><\/p>\n

This quantity question is also the idea behind the \u201crules\u201d that it\u2019s okay to use four lines or less of music lyrics or no more than ten percent of a work.\u00a0\u00a0<\/span><\/p>\n

These rules aren\u2019t actual rules. Still,<\/strong> they give a guideline of what\u2019s generally considered acceptable.<\/span><\/p>\n

When the case revolves around screenshots of videos or samplings of music, this quantity question factor is essential.<\/span><\/p>\n

If the new work is an audiovisual work (think movies or music), the courts will next ask, \u201cHow observable is the copied work in the new work?\u201d<\/strong><\/span><\/p>\n

In other words, they want to know the length of time the copied work appears on screen or can be heard in a musical work.\u00a0<\/span><\/p>\n

If a piece of art appears for 2 seconds in a full-length movie, the courts will likely find no infringement.<\/span><\/p>\n

If the art is visible for an entire 5-minute scene<\/strong>, then there may be a problem.<\/span><\/p>\n

How You\u2019re Using It Matter\u00a0<\/span><\/h2>\n

The last question is, \u201cHow prominent\/visible is the copied work in the new work?\u201d<\/strong>\u00a0<\/span><\/p>\n

If the case involves artwork appearing in a movie, the court will look at whether it\u2019s in the foreground or the background, whether the focus is on the artwork or something\/someone else in the scene, how clearly the artwork can be seen, etc.<\/span><\/p>\n

The idea here is to see how much attention is being drawn to the copied work.\u00a0<\/span><\/p>\n

If the copied work is \u201cbackground noise,\u201d then it\u2019s less likely the court will feel the need to enforce the copyright.<\/span><\/p>\n

De Minimis Is <\/span>Not<\/span><\/i>\u00a0a Guarantee<\/span><\/h2>\n

So what does this mean for your use?\u00a0<\/span><\/h3>\n

Again, I can\u2019t give any guarantees, but clearly, the less you use, the better.\u00a0<\/span><\/p>\n

The smaller the piece you use and the less prominent it is, the more likely it will be considered de minimis.<\/span><\/p>\n
