Trademark owners are always concerned about someone stealing their trademark<\/strong>, intentionally or unintentionally.\u00a0<\/span><\/p>\n

Here are some tips for the question I hear a lot: How do I protect my trademark?<\/span><\/p>\n

    \n
  1. \n

    Choose a unique and distinctive mark.<\/b><\/h2>\n

    This will help avoid the well-meaning infringers who didn\u2019t intend to step on your toes. <\/span>
    \n<\/span>
    \n<\/span>They didn\u2019t realize that their trademark just happens to be identical to yours. <\/span>
    \n<\/span>
    \n<\/span>That problem is much less likely to happen if you\u2019ve chosen something unique for your name (for example, a made-up word or a word that has nothing to do with your product or service.) <\/span>
    \n<\/span>
    \n<\/span>These highly distinctive marks have the added benefit of receiving extra protection under trademark law \u2013 the more unique it is, the better the protection.<\/span><\/li>\n

  2. \n

    Put a TM next to your mark.<\/b><\/h2>\n

    A straightforward way to protect your trademark. <\/span>
    \n<\/span>
    \n<\/span>This tells the world that you consider this to be a valid trademark, and you are willing to protect it as a trademark. <\/span>
    \n<\/span>
    \n<\/span>It cuts down on the unintentional infringers and can be helpful if you have to go to court.<\/span>
    \n<\/span><\/li>\n

  3. \n

    Register your mark.\u00a0<\/b><\/h2>\n

    Registration will give your trademark the most protection. <\/span>
    \n<\/span>
    \n<\/span>You can register your trademark on the state level or the federal level<\/strong>, but registering on the federal level with the <\/span>U.S. Patent and Trademark Office (<\/span>    USPTO<\/b><\/a>) <\/span>will give you nationwide protection, with the possibility of expanding your trademark into other countries. <\/span>
    \n<\/span>
    \n<\/span>You can also use the \u00ae symbol, which can only be used by trademarks registered with the USPTO. <\/span>
    \n<\/span>
    \n<\/span>There are additional benefits beyond these<\/strong>, like automatically being able to file a lawsuit in a federal court, but the perks I just listed tend to be the ones that people care about most.<\/span>
    \n<\/span>
    \n<\/span>A word of warning with federal registration: The USPTO is very particular about how you fill out the registration application. It\u2019s very easy to make a mistake that will either delay your application\u2019s approval or <\/span>    cause your application to be rejected<\/b><\/a>. <\/span>
    \n<\/span>
    \n<\/span>If you decide that federal registration is the best way to go<\/strong>, I would strongly recommend hiring an experienced professional to submit the application for you.<\/span>
    \n<\/span><\/li>\n

  4. \n

    Use your trademark consistently.<\/b><\/h2>\n

    Trademark protection is a \u201cuse it or lose it\u201d proposition.<\/span>
    \n<\/span>
    \n<\/span>If you stop using it entirely<\/strong>, it\u2019s considered abandoned, and someone else can pick it up. <\/span>
    \n<\/span>
    \n<\/span>If you want to hang on to your mark, keep it in your marketing, even if it only pops up occasionally. <\/span>
    \n<\/span>
    \n<\/span>The best way to protect your mark regularly is to use it across all your marketing channels and be very consistent and predictable with where your trademark mark pops up.<\/span>
    \n<\/span>
    \n<\/span>Infringers will sometimes try to use inconsistency as an excuse for why they thought it was okay to infringe.<\/strong> Don\u2019t give them the opportunity.<\/span><\/li>\n<\/ol>\n
